Many people from other EU Countries decide to come to Spain – particularly to Andalucia – and put their future into a start-up  business here. You just have to look at the plethora of Television programmes currently airing on exactly this topic to get an indication of this trend.

The good news is that Spanish legislation encourages such entrepreneurs, because they bring economic activity which might not otherwise exist, create employment and contribute tax revenues to both Local and National coffers.
The bad news is that far too many people undertake ventures of this kind with no understanding, or regard for, Local and Regional regulations – which apply equally to Spanish Nationals or Immigrants.

The regulations with which you must comply in order to start a business in Spain may not be the same as in your Country of origin. They are not necessarily better, or worse – they simply could be different. For example, all businesses must be registered with the Local Town Hall, who will issue a Licence to operate such business, once they are satisfied that all regulations – including Health and Safety, Environmental Considerations (e.g. you probably can’t open a manufacturing facility in the middle of a residential area), and whatever other Local Regulations might apply. There is also the issue of how you wish to structure your business. A Partnership? A Registered Company? A Sole Trader? What are the Legal and Tax implications of all or any of these?

Don’t sign a Lease for Business Premises, don’t apply to a Bank for Financing, don’t spend any money on Advertising your planned venture – and most of all, don’t just start conducting business without the necessary Permits and Licences.

The earlier you conduct a – completely free of charge – meeting with us, the more we will be able to help you. It may cost you a little time, but you will gain peace of mind; and, even more importantly, you will know that whatever you put into your business will be safe from any potential Legal action from the Authorities – including (and they have the power to do this) forced closure because you unknowingly failed to comply with some local regulation of which you had no knowledge.
